1. General Provisions

• Platform – the website Crewings.me, including all its pages, sub-platforms, mobile applications (if any), and other related resources.
• User – an individual using the Platform for the purposes of job searching, obtaining consultations, posting a sailor profile, or other professional information.
• Company – a legal entity or individual entrepreneur that can post job vacancies, information about itself, and interact with Users (crewing agency, maritime organization, training center, document company, etc.).
• Service – a set of services and functionalities provided by the Platform (including job search, posting and responding to vacancies, maintaining a professional profile, communicating with potential employers).

1.2 Subject of the Agreement

1. Provision of a Platform for Job Searching The Platform provides Users (sailors) with tools to create a profile, display professional information, and search for vacancies posted by Companies.
2. Posting Vacancies by Companies Companies can publish vacancies and other information to attract potential candidates (Users).
3. Creation of Maritime Specialist Profiles Users can create detailed profiles that include personal and professional data, resumes, certificates, and other relevant information.

2. Registration and Account

2.1 Registration Process

1. Data Requirements When registering, the User must provide accurate personal data, including but not limited to: full name, valid email address, phone number (if necessary), and any other information that may be required for full use of the Service.
2. Information Verification The Platform may conduct selective or systematic verification of the provided data (for example, email address verification) to ensure their accuracy and minimize the risk of fraud.
3. Email Confirmation To activate the account, email confirmation may be required. A confirmation link is automatically sent after the User enters their email.

2.2 User Obligations

1. Accuracy of Information The User guarantees that all information provided during registration and/or while using the Platform is accurate, up-to-date, and not misleading.
2. Data Relevance The User agrees to timely update their data (for example, if contact information, place of work, or qualifications change) so that the Platform can provide services correctly.
3. Account Security The User is personally responsible for the confidentiality of their login and password, as well as for all actions taken under their account. It is recommended to use strong passwords and not to share them with third parties.

3. Rules of Use

3.1 Permitted Use

1. Job Searching The User may use the Service tools to search for suitable vacancies, view information about companies, and respond to interesting offers.
2. Posting Vacancies Companies may post vacancies and relevant information that gives Users an understanding of the nature of the work, conditions, and requirements for candidates.
3. Communication with Companies The Platform provides opportunities for direct communication with potential employers or partners: sending messages, responses, receiving feedback on application status, etc.

3.2 Prohibited Actions

1. Spam and Fraud Sending unwanted messages, duplicating offers, and any fraudulent activity (including phishing, using someone else’s data, etc.) is prohibited.
2. False Information It is unacceptable to post knowingly false information about oneself, one’s skills, education, work experience, etc., with the intent to mislead Companies or other Users.
3. Violation of Other Users' Rights It is prohibited to publish materials containing personal data of third parties without their consent, as well as any materials that violate copyright and other rights.

4. Rights and Obligations

4.1 Rights of the Platform

1. Content Moderation The Platform reserves the right to review and edit (or delete) any content posted by Users and Companies if such content contradicts these Terms, legislation, or is misleading.
2. Blocking Violators The Platform may suspend or block access for Users or Companies that violate these Terms (for example, when posting illegal content, fraudulent vacancies, etc.).
3. Functionality Changes The Platform has the right to make changes at any time, add new features, or restrict access to existing features, while notifying Users of such changes whenever possible.

4.2 Obligations of the Platform

1. Ensuring Availability The Platform strives to ensure round-the-clock availability of the service, except for time spent on technical work or circumstances beyond control.
2. Technical Support The Platform provides Users and Companies with a communication channel (email, chat, or feedback form) to resolve technical and organizational issues.
3. Data Protection The Platform commits to comply with the Privacy Policy, implement appropriate measures to protect personal data, and act in accordance with GDPR and other applicable legislation.

5. Intellectual Property

5.1 Rights of the Platform

1. Trademarks All trademarks, logos, trade names, and other intellectual property objects used on the Platform belong to their rightful owners and are protected by copyright law.
2. Source Code The source code, design, architecture of the Platform, and other elements related to the software part belong to CrewingsMe LTD and may not be reproduced or used without permission.
3. Design and Content The overall design, interfaces, graphic elements, texts, and other materials created by the Platform are protected by copyright and may not be copied or distributed without written consent from CrewingsMe LTD.

5.2 Rights of Users

1. Posted Materials The User retains copyright to any content (resumes, photos, descriptions) that they upload to the Platform. The User grants the Platform a non-exclusive license to use and display such content within the operation of the Platform.
2. Personal Data Personal data provided by the User is processed in accordance with the Privacy Policy and data protection legislation.
3. Reviews and Comments The User may post reviews, comments, or other materials related to their experience with the Platform, provided that such information is accurate and does not violate the rights of third parties.

6. Liability

6.1 Limitation of Liability

1. Quality of Vacancies The Platform is not responsible for the completeness, relevance, and accuracy of information about vacancies posted by Companies. Each Company is solely responsible for the content of its publications.
2. Actions of Companies The Platform is merely an intermediary between the User and Companies. All employment relationships, payment agreements, and other obligations arise directly between the User and the Company. CrewingsMe LTD is not responsible for the actions or inactions of companies, their internal policies, financial obligations, quality of offered vacancies, etc.
3. Technical Failures The Platform does not guarantee absolute error-free and uninterrupted operation. In the event of unforeseen technical problems or failures, we will strive to restore normal operation as soon as possible, but we are not responsible for losses or damages caused by access interruptions.

6.2 User Responsibility

1. For Provided Information The User guarantees that all information posted by them on the Platform (including personal data, experience descriptions, resumes, etc.) does not violate the rights of third parties and is accurate.
2. For Their Actions The User is solely responsible for complying with legal norms, for the correctness and ethics of their behavior when interacting with other Users and Companies.
3. For Violating Terms If the User violates these Terms, legislation, or causes damage to the Platform and/or third parties, they are obliged to compensate for such losses in accordance with applicable law.

7. Payment and Subscriptions

7.1 Tariffs

1. Price Structure Paid services or subscriptions, if provided, may be indicated on the relevant pages of the Platform. We strive to provide clear information about the cost and scope of services to eliminate ambiguities.

2. Cancellation of Subscription The User may terminate the subscription before the end of the paid period in accordance with the cancellation rules established by the Platform. Funds for the unused period may not be refunded unless otherwise provided by the refund policy.
3. Refunds Refund conditions (full or partial) are regulated by a separate refund policy of the Platform or applicable legislation. If the User believes they are entitled to a refund, they can contact support with the appropriate request.

10. Dispute Resolution

1. Pre-Trial Settlement Before contacting the courts, the User and the Platform must attempt to resolve the dispute in a pre-trial manner (for example, by sending a claim via email and providing a reasonable time for a response).
2. Applicable Law For Users, companies, and other persons interacting with the Platform, the legislation of the country of registration of CrewingsMe LTD applies unless otherwise provided by mandatory legal norms.
3. Jurisdiction All unresolved disputes in a pre-trial manner are considered by the court at the location of registration of CrewingsMe LTD or in another judicial body determined by mutual agreement of the parties and relevant agreements.
